Copyright (DMCA) Policy

StellaBase respects copyright and expects the businesses using StellaBase to do the same. Businesses are responsible for the photos, text and other material on their sites (see our Terms and Acceptable Use Policy). We respond to valid notices under the Digital Millennium Copyright Act, 17 U.S.C. § 512.

Our designated agent

Send copyright notices through our report form. You can also use the report form, or the “Report this site” link at the bottom of any site we host.

What a notice must include

  1. A physical or electronic signature of the copyright owner or someone authorized to act for them.
  2. Identification of the copyrighted work you say is infringed.
  3. The web address (URL) of the material, with enough detail for us to find it.
  4. Your name, mailing address, phone number and email.
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

Knowingly misrepresenting that material is infringing can make you liable for damages (17 U.S.C. § 512(f)).

What we do

When we get a complete notice, we remove or disable the material (or take the site offline) promptly, tell the business, and send them a copy of the notice.

Counter-notice

If you’re the business and believe the material was removed by mistake or misidentification, send our agent a counter-notice with: your signature; identification of the material and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; and your name, address and phone number, with a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any district where StellaBase may be found) and will accept service from the person who sent the notice. We forward it to the complainant and may restore the material in 10 to 14 business days unless they tell us they’ve filed a court action.

Repeat infringers

We close the accounts of businesses that are repeat infringers in appropriate circumstances.
